Website Terms of Use

1.1. These Terms of Use govern the relationships between COASTVENTURE S.L., a limited liability company registered under the laws of Spain, CIF B56309883, with office and management address at Av. Ernesto Sarti 10, 38660 Costa Adeje, Santa Cruz de Tenerife (hereinafter referred to as "CoastVenture") and the users of the website.

1.2. With each use of the website's resources, the users declare that they are familiar with these  Terms of Use, agree with them and undertake to comply with them.

 

2.1. The resources of the website are as follows:

• information about the business activities of CoastVenture and CoastFlat;
• information about the services of CoastVenture and CoastFlat and their pricing plans;
• information about how the services are provided and how they work;  
• information about the areas, where the services CoastVenture and CoastFlat are offered;
• news and articles connected with the sphere of business of CoastVenture and CoastFlat;
• links to the maintained by CoastVenture and CoastFlat websites in social networks;
• contact form for making contact with CoastVenture and CoastFlat; 

2.2. The users of the website may access the materials uploaded to the website.

2.3. Website technology and design are subject to change by CoastVenture without prior notice.

 

3.1. Any and all intellectual property rights associated with the website and its contents are the sole property of and CoastVenture. Intellectual property rights are protected by the Copyright Act and related rights, and any use of content from the website, without the consent of CoastVenture, is a violation of the law, which may result in civil, administrative and/or criminal liability.

3.2. The website contains information, materials, features, and other content that constitute copyrighted and related rights and contains such objects as trademarks, logos, trademarks, product and service names, and other similar protected objects of rights. The user may not copy, reproduce, modify, amend, lease, loan, sell and/or create derivative works from, upload, transmit, and/or distribute the Intellectual Property of the website in any way without CoastVenture's prior written permission.

3.3. In the case of copying and/or reproduction of information beyond what is permissible, as well as in case of any other violation of intellectual property rights on the resources of CoastVenture, CoastVenture has the right to claim compensation for direct and indirect damages suffered in full.

3.4. The use of the website or protected sites under the previous articles, in violation of the provisions of these Terms of Use, in addition to violating the agreements between users and CoastVenture, may also constitute a violation of rights on objects that are the subject of foreign intellectual and/or industrial property, as well as other legally protected rights and legitimate interests of CoastVenture and/or third parties. For any violation under this article, the relevant user assumes all liability - civil, administrative and/or criminal, and the payment of compensation imposed by a competent authority to the affected persons.

3.5. CoastVenture has the right to compensation for all damages, expenses and claims of third parties that are a consequence of a violation of these Terms of Use and/or unregulated use of the services on the website.

 

4.1. CoastVenture takes the necessary measures to keep the content of the website up-to-date, but is not responsible for the actual up-to-dateness of the same. In this regard, CoastVenture is not responsible for damages, including direct and/or indirect damages, including lost profits, that a user of the website would suffer under any circumstances related to the published content of the website and access to it. By using the website, users assume all risks associated therewith, including any risk to users' end devices, software and/or data.

4.2. To the extent that the content of the website contains links to content located outside the same, the user is aware of the fact that CoastVenture has no control over the same and is not responsible for the consequences of activating links leading outside the website.

4.3. CoastVenture is not responsible for the subjective perceptions and/or interpretation of the accuracy, completeness and usefulness of the information resources on the website.

4.4. CoastVenture is not responsible for malicious actions by third parties, which the user could suffer, when using the website. The user uses the website at his own risk.

4.5. CoastVenture shall not be liable for any incidental, direct, indirect, exemplary, punitive and/or consequential damages, lost profits, and/or damages resulting from lost data or  interruption resulting from the use of and/or inability to use the website.

 

5.1. Users of the website accept and undertake to comply with these Terms of Use. With each use of services and resources from the website, including opening an Internet page from the website, users declare that they are familiar with these Terms of Use, agree with them and undertake to comply with them.

5.2. Users should use the website in good faith, including not taking malicious actions that may affect the accessibility of the content to third parties and/or the use of the website in general.

5.3. The use of the website is available  without the need of  prior registration by the users.

5.4. The use of the website is free and available 24 hours a day, 7 days a week (24x7) for the users.

5.5. Any use of the content of the website, including recording, copying, publishing, reproduction, distribution, broadcasting, transmission and/or retransmission over an electronic communications network, publication on the Internet, public display, processing and/or use in any other way way, outside of those specified in these Terms of Use, can only be done with the express permission of CoastVenture. 

 

6.1.  CoastVenture may revise and update these Terms of Use at any time, whereas the current Terms of Use will be published on  the website at any moment. Your usage of the Website after any changes to these Terms of Use will be deemed as acceptance of such changes. Any aspect of the Website may be changed, supplemented, deleted or updated without notice, at the sole discretion of CoastVenture. 

6.2. If any provision of these Terms of Use shall be found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. 

6.3. These Terms of Use are governed by the provisions of the applicable Spanish legislation.
